As someone who has been dealing with law and legal matters for over 3 decades, I have come across various cases that seemed unsolvable to many.
Many times, clients have visited me claiming that they had spent a lot of time, money, and energy trying to resolve their problem but had not reached a solution.
What I notice in practice is that for many of these issues, the solution not only exists but is also very simple, if you have enough experience and knowledge in certain areas.
Allow me to present one of these cases. I will try to simplify the story and explain the solution so that everyone can understand the matter.
This concerns a cadastral record with 15 registered individuals, with names and surnames, as well as 3 unmarked individuals, known as “unknown holders.” To make the situation even more complicated for the client, everything was located on a single cadastral parcel, with undetermined co-ownership shares.
How did I manage to resolve this record? The situation was resolved through a non-litigation procedure, with a ruling on the regulation of usage, property rights, houses, and the area of usage on the same cadastral parcel.
The court delivered everything to the cadastre for the implementation of the registration based on the court ruling, with marked co-ownership shares and the individuals who are owners with private property and holders on the same cadastral parcel.
The unknown individuals who could not be found at the address were resolved with a “temporary representative/lawyer” during the procedure. The registration was resolved.
I notice that such cases are very common in the Belgrade area, where everyone purchased on the outskirts of “Banjica, Višnjica,” and similar areas.
A single cadastral parcel was most often purchased from one owner at that time, and we must remember that this was more than 50 years ago, when the area was still not urbanized and resembled more of a suburban place. The owner from whom they bought, without a notarized contract, passed away, and this is when the legal complication arose, which seemed unsolvable to many. The individuals, about 15-20 of them, who purchased with contracts THAT WERE NOT NOTARIZED, were also resolved in the above-mentioned way.
